These Terms & Conditions (“Terms”) govern your use of mobilitycity.com and related webpages, forms, and online features that link to these Terms (the “Website”). The Website is operated by Mobility City Holdings, Inc. (“Mobility City Holdings,” “we,” “us,” or “our”). In these Terms, a “location” means an individual Mobility City showroom or service business. Many locations are independently owned and operated franchises.
By using the Website or submitting a request through it, you agree to these Terms. If you do not agree, please do not use the Website.
Equipment sales, rentals, repairs, deliveries, installations, service plans, financing, and other transactions may also be governed by a written estimate, work order, invoice, receipt, rental agreement, warranty, service plan, financing agreement, or other transaction document (“Transaction Documents”). If a Transaction Document conflicts with these Terms, the Transaction Document controls for that transaction, unless applicable law requires otherwise.

1. About Mobility City and Our Franchise System
Mobility City Holdings operates this Website and franchises the Mobility City brand. Mobility City locations provide mobility equipment repairs, rentals, sales, battery replacement, delivery, setup, installation, and related services through showrooms and mobile service vans.
Each location is responsible for its own products, services, staff, scheduling, estimates, payments, refunds, and legal obligations, except where a Transaction Document identifies Mobility City Holdings as the seller or provider. A franchise owner is not an agent, partner, joint venturer, or employee of Mobility City Holdings. Mobility City Holdings is not responsible for a location’s obligations unless it expressly agrees in writing or applicable law requires otherwise.
When you submit a request, we may route it to the location that serves your ZIP code, address, or requested service. Service areas may change, and some services may not be available in every area.
2. Using This Website
Subject to these Terms, you may use the Website for lawful personal purposes, including learning about Mobility City products and services, finding a location, and submitting a request. Prospective franchise owners and job applicants may also use the relevant pages for those purposes.
You agree not to:
- provide false, misleading, or incomplete information, impersonate another person, or submit a request for another person without authority;
- use the Website for an unlawful, fraudulent, harassing, abusive, or deceptive purpose;
- submit spam, bulk or automated form entries, or entries intended to test, manipulate, or interfere with lead routing, analytics, or advertising;
- copy, scrape, harvest, or collect Website content or information by automated means without our written permission, except for standard search-engine indexing;
- introduce malicious code or attempt to gain unauthorized access to the Website, related systems, or data;
- interfere with the security, performance, or operation of the Website;
- use Mobility City names, logos, or content in a way that suggests affiliation, sponsorship, or endorsement without written permission; or
- collect information about customers, locations, franchise owners, or employees for unsolicited marketing.
You must be at least 18 years old to enter into a transaction. If you submit a request for another person, such as a family member or someone in your care, you confirm that you are authorized to provide that person’s information and to act for that person.
3. Website Information, Availability, and Offers
We try to keep Website information accurate and current. However, products, models, specifications, images, inventory, rental equipment, service availability, delivery areas, location hours, financing options, and promotions can change and may vary by location. Product images may be illustrative, and specifications may be provided by manufacturers.
Website information is not an offer that you can accept by submitting a form. Your request is subject to confirmation by the applicable location. Equipment availability, service timing, and transaction terms are confirmed by the location before the transaction is completed.
Specials and promotions are available only from participating locations, during the stated period, while supplies last, and subject to the stated terms, eligibility requirements, and service-area limits. Unless the offer states otherwise, offers cannot be combined, are not transferable, have no cash value, and are void where prohibited.
Program response times, including Rapid Response timing, apply as described in the applicable program information. They may be affected by service area, parts availability, VA or other third-party authorization, weather, safety, access, or other conditions outside the location’s reasonable control. If a location cannot meet a stated commitment, it will work with you on available options.
We may correct errors, inaccuracies, or omissions in Website information, including offer details, at any time.
4. No Medical, Clinical, Insurance, or Benefits Advice
Website content is for general information only. It is not medical, clinical, therapy, insurance, legal, or benefits advice, and it does not replace advice from your physician, therapist, case manager, or another qualified professional. Consult a qualified professional about medical needs, safe transfers, positioning, fall risk, seating, and whether equipment is appropriate for you.
Equipment recommendations depend on accurate information about the user, home or facility, vehicle, and intended use. Some equipment, including complex rehab power wheelchairs and custom manual wheelchairs, may require an assessment, measurements, documentation, or approval from a qualified professional before it can be ordered or provided.
Prescription, insurance, Medicare, Medicaid, VA, HSA, FSA, and other benefit requirements vary. Unless a location confirms otherwise in writing, you are responsible for confirming eligibility and coverage with the applicable payer, agency, or plan administrator.
5. Requests, Appointments, and Service Visits
Submitting a form, calling, or requesting an appointment does not guarantee a specific appointment, technician, delivery window, or outcome. An appointment is confirmed only when the location confirms it.
For in-home, facility, or other on-site service, you agree to:
- provide accurate address, access, equipment, and contact information;
- make sure an adult who can authorize the work is available when needed;
- provide safe access to the equipment and work area, including reasonable lighting and clear pathways;
- secure pets and tell the location about known hazards, safety concerns, or access restrictions; and
- obtain any permission needed from a landlord, facility, homeowners association, or property owner.
A technician may decline, pause, or reschedule service if the location reasonably believes conditions are unsafe, required authorization is missing, the equipment cannot be serviced safely on site, or the requested work is outside approved Mobility City services. Mobility City locations do not perform construction-related bath safety installations or structural modifications that involve cutting, drilling into tile, plumbing changes, or similar construction work.
Please contact the location as early as possible if you need to cancel or reschedule. Any cancellation or rescheduling terms will be stated in your Transaction Documents or communicated before the appointment is confirmed.
6. Repairs, Batteries, and Parts
A technician will diagnose the reported issue and explain available repair options. Estimates are based on the information available at the time and may change if additional problems, parts needs, safety concerns, or warranty limitations are found. Except in an emergency or where you have authorized otherwise, the location will request your approval before performing work outside the approved estimate.
Repair timing depends on diagnosis, parts availability, manufacturer approval, and access to the equipment. If parts must be ordered, the location may offer rental or loaner equipment where available. Rental and loaner equipment is subject to Section 7.
Warranty repairs are subject to the manufacturer’s warranty terms, coverage decision, and approval. A location may help check warranty status or submit a warranty claim, but it cannot guarantee that a manufacturer will approve coverage.
Unless you ask to keep replaced parts before work begins, or the parts must be returned to a manufacturer for warranty processing, you authorize the location to recycle or dispose of replaced batteries and parts in accordance with applicable law.
Inspect and test repaired equipment as instructed before regular use. Contact the location promptly if equipment does not perform as expected after service, and stop using equipment that appears unsafe.
If equipment is left at a showroom for service, please pick it up within the period stated by the location after you are told that the work is complete or that the equipment cannot be repaired. Unclaimed equipment may be handled as permitted by applicable law and your Transaction Documents.
7. Rentals and Loaner Equipment
Rental and loaner equipment is subject to availability, the location’s rental or loaner agreement, and any identification, payment, delivery, pickup, or other requirements disclosed before the rental begins. Rental periods, renewal, early return, and late return terms are governed by that agreement.
Unless the agreement states otherwise, you agree to:
- use the equipment only for the intended user and purpose, and only according to the manufacturer’s instructions, training, weight limits, and safety warnings;
- not modify, repair, sublease, lend, sell, or remove identifying labels from the equipment;
- keep the equipment in a safe, clean, and secure place and protect it from loss, theft, misuse, and damage beyond normal wear;
- use the equipment only in the places and conditions permitted by the agreement;
- stop using the equipment and contact the location immediately if it is damaged, malfunctions, or appears unsafe; and
- make the equipment available for inspection, service, replacement, or pickup at the agreed time.
Responsibility for loss, theft, or damage beyond normal wear is governed by the rental or loaner agreement and applicable law. Rental eligibility varies by equipment type and location. Some items, such as bath safety products, batteries, cushions, mattresses, rollators, parts, and certain beds or lift chairs, may not be available for rent.
8. Equipment Sales, Delivery, Installation, and Test Drives
Equipment sales are subject to availability and confirmation by the location. Special-order, custom, configured, or complex rehab equipment may require deposits, measurements, assessments, manufacturer lead times, and additional documentation, as stated in your Transaction Documents.
White Glove Delivery, assembly, setup, product training, packaging removal, and installation are provided as described by the location and are subject to service area, equipment type, access, and safety conditions. Delivery dates are estimates unless your Transaction Documents state a guaranteed date.
Ramps, stair lifts, patient lifts, vehicle lifts, and similar accessibility equipment are installed only by trained and qualified personnel, according to manufacturer guidelines, and subject to required permits, licensing, local codes, site conditions, and property-owner approval. You are responsible for obtaining required property-owner or facility approval unless the location agrees in writing to obtain it.
Title and risk of loss pass as stated in your Transaction Documents or, if they do not address it, as provided by applicable law.
Test drives and product demonstrations, including showroom test tracks, are subject to staff supervision, safety instructions, and equipment limits. Please tell staff about anything that may affect your safe use of the equipment and follow all instructions. Staff may decline or end a test drive if they believe it is unsafe.
9. Payments, Financing, VA Services, and Third-Party Coverage
Estimates, invoices, deposits, accepted payment methods, taxes, and other payment terms are provided by the applicable location in your Transaction Documents. You agree to pay amounts due under your Transaction Documents when due.
Financing, leasing, lease-to-own, and credit programs may be offered by third-party providers, such as Acima or CareCredit, and may differ by location. Applications, approvals, credit decisions, payment schedules, and program terms are determined by the provider and its agreement, not by these Terms. Mobility City Holdings and its locations do not guarantee approval. Review the provider’s terms carefully before applying or signing.
HSA and FSA eligibility depends on your plan and applicable rules. Insurance, Medicare, Medicaid, and other third-party payment sources are not guaranteed and are accepted only where the location confirms in writing. You are responsible for amounts not covered, approved, or paid by a third-party payer, unless applicable law or your Transaction Documents provide otherwise.
Eligible Veterans may receive covered equipment or services when authorized by the U.S. Department of Veterans Affairs. The VA determines eligibility, authorization, and the scope of covered services. If a requested product or service is outside the VA authorization, the location will tell you before providing it, and you will be responsible only for items or services that you agree to in advance.
10. Cancellations, Returns, and Refunds
Cancellation, return, exchange, and refund terms are set by the location and stated in your Transaction Documents or provided before you complete the transaction. Please ask the location for its policy before purchase.
Where permitted by law, special-order, custom, configured, installed, used, or hygiene-sensitive items, such as bath safety equipment, cushions, and mattresses, may have limited return eligibility.
If a sale is made at your home or another place covered by the FTC Cooling-Off Rule or a similar state law, you will receive any required notice of your right to cancel. Nothing in these Terms limits any cancellation, refund, warranty, or other consumer right that cannot be waived under applicable law.
11. Warranties and Service Plans
Equipment may be covered by a manufacturer’s written warranty. The manufacturer’s warranty document controls coverage, exclusions, claim procedures, and remedies. Copies of written warranties are available from the location before purchase where required by law.
Extended warranty plans, service plans, and protection plans are governed by the plan documents provided at enrollment, including eligibility requirements, coverage periods, exclusions, and claim procedures. Any repair workmanship coverage is described in the location’s Transaction Documents.
The disclaimers in Section 20 apply to the Website and its content. They do not disclaim or limit any written warranty, service plan, or implied warranty that applies to a product or service and cannot be disclaimed or limited under applicable law.
12. Equipment Safety and Your Responsibilities
Mobility equipment can involve risks such as falls, tip-overs, pinch points, and electrical or battery hazards. Proper use and maintenance are important. You agree to:
- read and follow the manufacturer’s manual, labels, safety warnings, weight capacities, battery and charging instructions, and maintenance guidance;
- use equipment only for its intended purpose and, when applicable, only by the person for whom it was selected or approved;
- not modify equipment, override safety features, or use incompatible parts, batteries, or chargers;
- stop using equipment that is damaged, unstable, overheating, leaking, or not operating properly, and contact the location or manufacturer;
- ask for training if you or a caregiver is unsure how to use, fold, transport, charge, or transfer from the equipment; and
- respond to manufacturer recalls and safety notices.
13. Calls, Emails, and Text Messages
Calls and call recording. All calls routed through Mobility City’s CallRail system are recorded for customer quality assurance. CallRail is our service provider for call routing, tracking, and recording. A recording notice is played before the conversation proceeds. If you continue the call after the notice, you consent to the recording. If you do not want the call recorded, you may end the call and contact us through the online contact form or by email instead.
Because Mobility City is a franchise system, authorized Mobility City corporate personnel and authorized personnel at the specific location you called may listen to the recording for quality assurance, customer service, training, coaching, issue resolution, and operational improvement. Please do not share full payment card numbers, Social Security numbers, or medical records during a call unless a team member directs you to an approved secure process.
Email. If you opted in to marketing emails, Mobility City Holdings and the applicable location may send marketing follow-up, updates, and offers by email. You may unsubscribe at any time using the link in a marketing email. We and the applicable location may send receipts, confirmations, appointment information, service updates, and other transactional emails whether or not you opted in to marketing. These messages are sent through a secure email delivery process, as described in our Privacy Policy.
Text messages. If you opt in to Mobility City text messages, you agree to receive recurring text messages from Mobility City Holdings and the applicable location at the mobile number you provide. Messages may include updates, promotions, news, appointment information, and information about your requests. Message frequency varies. Message and data rates may apply. Consent to marketing text messages is not a condition of purchase. Reply STOP to opt out or HELP for help. Wireless carriers are not liable for delayed or undelivered messages. Please tell us if you change or deactivate your mobile number.
Marketing calls. If you tell a team member that you do not want marketing calls, your request will be added to the applicable internal do-not-call record. Calls about a request you made, an appointment, a transaction, or service may continue where permitted by law.
Electronic communications. To the extent permitted by law, you agree that receipts, notices, and other communications provided electronically by Mobility City Holdings or a location satisfy any requirement that those communications be in writing.
14. Privacy
Our Privacy Policy explains how we collect, use, disclose, store, and retain personal information, including information related to call recordings, email communications, marketing and lead-generation partners, cookies, analytics, and retargeting. Please review it to understand our practices and your privacy choices.
15. Reviews, Feedback, and Other Submissions
You may share honest reviews and opinions about Mobility City products, services, locations, and customer service. Nothing in these Terms restricts or penalizes you for posting an honest review.
If you submit a review, testimonial, comment, photo, video, suggestion, or other content to us or through the Website (“Submission”), you keep any ownership rights you have in it. You grant Mobility City Holdings and authorized Mobility City locations a non-exclusive, royalty-free license to use, reproduce, display, and distribute the Submission in connection with the Mobility City business, subject to our Privacy Policy and applicable law. We will request your permission before using your name, image, or likeness in advertising when required by law.
You are responsible for your Submissions and must have the right to submit them. On Website pages we control, we may decline to publish or may remove a Submission that contains another person’s personal information or likeness; is libelous, harassing, abusive, obscene, vulgar, sexually explicit, or inappropriate with respect to race, gender, sexuality, ethnicity, or another intrinsic characteristic; is unrelated to our products or services; is clearly false or misleading; contains confidential, privileged, medical, or personnel information; contains malicious code; or is otherwise unlawful.
Customer reviews and testimonials reflect individual experiences. Your experience may differ based on your needs, equipment, location, and other factors.
16. Intellectual Property and Trademarks
The Website and its content, including text, graphics, photographs, videos, logos, design, and software, are owned by or licensed to Mobility City Holdings or its licensors and are protected by intellectual property laws. Except for the limited right to use the Website under these Terms, no license is granted to you.
Mobility City names, logos, and related marks are trademarks of Mobility City Holdings, Inc. Manufacturer and other third-party names and logos belong to their respective owners. Their appearance on the Website does not mean that the owner endorses Mobility City unless the Website expressly says so.
You may share links to Website pages for non-commercial purposes if the link is not misleading and does not suggest an affiliation or endorsement. You may not frame the Website or use Mobility City marks without written permission.
17. Third-Party Services and Links
The Website may link to or include third-party services, such as financing and leasing providers, location-search tools, maps, video platforms, social media, manufacturer websites, and payment processors. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, products, services, or practices, except where required by law.
18. Franchise Opportunity and Career Information
Franchise information on the Website is for general information only and is not an offer to sell a franchise. An offer to sell a franchise can be made only through a current Franchise Disclosure Document and in compliance with applicable federal and state franchise laws. Some states require registration or filing before a franchise may be offered or sold to a resident of that state or for a franchise located in that state. We will not offer or sell a franchise in any such state until applicable requirements are satisfied.
The Website is not intended to make any financial performance representation. Any financial performance representation will be provided only as permitted in Item 19 of the applicable Franchise Disclosure Document. Review the Franchise Disclosure Document carefully and consult your own legal and financial advisers before making a franchise decision.
Job postings for a franchise location are posted by or for that independently owned business, which makes its own hiring and employment decisions. A job posting does not create an offer of employment or an employment contract.
19. Accessibility
Mobility City serves people with disabilities, seniors, Veterans, and caregivers, and we want the Website to be usable by everyone. 20. Website Disclaimers
To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available.” Mobility City Holdings does not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that Website content will be complete, accurate, or current at all times.
This Section applies only to the Website and its content. It does not disclaim or limit any written product warranty, service plan, or implied warranty that applies to a product or service and cannot be disclaimed or limited under applicable law.
21. Limitation of Liability
To the fullest extent permitted by law, Mobility City Holdings and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Website.
Liability for a product, rental, repair, delivery, installation, or other service is governed by the applicable Transaction Documents, written warranties, service plans, and applicable law. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited under applicable law.
22. Responsibility for Misuse
To the extent permitted by law, you are responsible for claims and losses that result from your violation of these Terms, misuse of the Website, or violation of another person’s rights. This Section does not apply to claims caused by our negligence or misconduct, or to your lawful exercise of your rights, including posting an honest review.
23. Concerns, Disputes, and Governing Law
If you have a concern about a product, rental, repair, delivery, installation, or other service, please contact the location first. If the concern is not resolved, you may contact Mobility City Holdings, and we will review it with the location as appropriate. Our review does not make Mobility City Holdings a party to the transaction or responsible for the location’s obligations unless we agree in writing or applicable law requires otherwise.
If you have a concern about the Website or these Terms, we encourage you to contact us first as described in Section 26 with a description of the issue and the outcome you request. We will try in good faith to resolve the concern within 30 days.
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. This choice of law does not deprive you of protections under mandatory consumer protection laws of the state where you live or where products or services are provided.
Except where applicable law provides otherwise, claims relating to the Website or these Terms must be brought in the state or federal courts located in Palm Beach County, Florida. Either party may bring a qualifying individual claim in small claims court in the county where you live or where the products or services were provided. Claims arising from a transaction with a location are governed by the dispute provisions, if any, in the applicable Transaction Documents and by applicable law.
24. Changes to the Website and These Terms
We may update, suspend, or discontinue all or part of the Website at any time. We may revise these Terms from time to time and will post updated Terms on this page with a revised “Last Updated” date. Changes take effect when posted unless a later date is stated or applicable law requires additional notice. Changes do not apply retroactively to a dispute that arose before the change was posted. Your continued use of the Website after updated Terms are posted means you accept the updated Terms.
We may suspend or restrict access to the Website or a Website feature if we reasonably believe someone has violated these Terms, misused the Website, or created a security, legal, or safety risk.
25. General Terms
- Complete terms: These Terms, the Privacy Policy, and any applicable Transaction Documents make up the terms governing the subjects they address.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted.
- No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: You may not transfer your rights under these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.
- Events beyond reasonable control: Neither Mobility City Holdings nor a location will be responsible for a delay or failure caused by events beyond reasonable control, such as severe weather, natural disasters, utility or internet failures, supply-chain disruptions, manufacturer delays, labor disruptions, government actions, or public health emergencies.
- Locations: Mobility City locations may rely on provisions of these Terms that apply to them.
- Interpretation: Headings are for convenience only. The word “including” means “including without limitation.”
